This intensive course is led by a retired Judge and examines the key rights of the European Convention on Human Rights affecting the provision of social care in the United Kingdom.
- Article 5 (Right to Liberty and Security)
- Article 8 (Right to Respect for Private and Family Life)
- Article 9 (Freedom of Thought, Conscience and Religion)
- Article 14 (Discrimination)
- We explore how the provisions of the Convention are applied to UK law through the medium of the Human Rights Act, and how the Convention Rights affect decision making under the Mental Capacity Act, Deprivation of Liberty Safeguards and the Mental Health Act.
- We consider leading cases including Cheshire West, P & Q v Surrey County Council, Hillingdon and Bournewood.
